Shank Terms and Conditions

1. Acceptance of Terms

By accessing our website or booking and using our services, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree to these Terms, you must not use our website or services.

2. Bookings and Payment

• Bookings may be made and paid online.
• Bookings are confirmed only once full payment has been received.
• Walk-ins are welcome, subject to availability.
• Walk-in customers must pay before their session begins.
• Shank reserves the right to change its prices at any time. Price changes will not affect bookings that have already been confirmed and paid for.
• Additional charges for optional services, products, or damage to equipment may apply and will be communicated before they are charged.

3. Assumption of Risk

Golf simulator activities involve inherent risks, including the risk of personal injury, property damage, or loss arising from the use of golf clubs, golf balls, simulator equipment, or the actions of other participants.

By booking and participating, you voluntarily accept these ordinary and foreseeable risks. You agree to follow all safety rules, exercise reasonable care, and comply with the instructions of Shank staff at all times.

4. Limitation of Liability

To the fullest extent permitted by law, Shank shall not be liable for:

• Personal injury;
• Damage to personal property;
• Loss or theft of personal belongings;
• Negligence or misconduct of other customers;
• Interruptions caused by power failures, software errors, or simulator malfunctions.

5. Force Majeure

Shank will not be held liable for any interruption, delay, or cancellation of services resulting from unforeseen, unavoidable, or circumstances beyond its reasonable control, including but not limited to:

• Load shedding,
• Internet outages,
• Equipment failure,
• Natural disasters, or
• Government restrictions.

Where a booking is affected by such circumstances, the customer will be entitled to a credit in accordance with Shank’s Refund Policy.

6. Right to Refuse Entry or Remove Customers

Shank reserves the right to refuse entry to, or require the immediate removal of, any customer whose conduct poses a risk to the safety or wellbeing of others, causes damage to property or equipment, or breaches these Terms and Conditions or any instructions given by staff.

This includes, but is not limited to:

• Reckless or unsafe behaviour,
• Abusive or threatening conduct,
• Intoxication,
• Unlawful activity,
• Misuse of equipment, or
• Failure to comply with safety rules.

Where a customer is refused entry or removed for any of the above reasons, Shank reserves the right to cancel the booking without a refund (to the extent permitted by the law).

7. Health Declaration

By participating, you confirm that you:

• Are physically capable of taking part in golf simulator activities;
• Understand that golf involves physical movement; and
• Will stop participating and notify a staff member if you become injured or unwell.

8. Damage to Equipment

Customers are responsible for any damage caused by reckless behaviour, intentional misconduct, failure to follow safety rules, or unauthorised use of equipment.

This includes, but is not limited to, damage to projector screens, launch monitors, rental clubs, televisions, computers, or any other equipment on the premises.

9. Rules of Use

For the safety and enjoyment of all customers:

• Only one person may swing a golf club at a time.
• Please ensure your clubs are clean before use.
• No running.
• No food or drinks near electronic equipment.
• Only approved golf balls may be used.
• Weapons, abusive behaviour, and unlawful conduct are strictly prohibited.
• Follow all instructions given by staff.
• No smoking or vaping inside the premises.
• Spiked golf shoes, high heels, or any footwear that may damage the artificial grass are not permitted.

10. Age Restrictions

Children under the age of 12 must be accompanied by a responsible adult unless participating in an approved Shank junior coaching programme.

11. Equipment Use

• Customers may use their own golf clubs, provided they are clean and in good condition.
• Rental clubs are available, subject to availability.
• Left-handed rental clubs may be limited.

12. Session Time Limits

Session Duration

A standard round of 18 holes for one player takes approximately 60 minutes, depending on the player’s skill level and pace of play. Customers are encouraged to book sufficient time to complete their round.

Over Time

If your booked session expires before you have completed your round, you may request additional playing time, subject to availability. Additional charges may apply.

Shank reserves the right to end a session immediately in cases of emergency, misuse of equipment, reckless behaviour, intentional misconduct, or failure to follow safety instructions.

13. Photography, Videography and CCTV

From time to time, Shank may take photographs or videos for marketing and promotional purposes. If you do not wish to appear in any photographs or videos, please notify a staff member upon arrival.

Our premises are monitored by CCTV for the safety and security of our customers, staff, and property. By entering the premises, you acknowledge that CCTV surveillance is in operation. Any personal information collected through CCTV will be processed and stored in accordance with applicable South African law and will only be accessed or disclosed where permitted or required by law.

14. Privacy (POPIA)

Shank is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013.

We collect and process personal information—such as your name, contact details, and booking information—only for legitimate business purposes, including processing bookings, communicating with customers, processing payments, and improving our services.

Your personal information will be stored securely and will not be shared with third parties unless required by law, necessary to provide our services, or with your consent.

By using our services, you acknowledge that your personal information will be collected and processed in accordance with this Privacy Policy.

15. Governing Law

These Terms and Conditions will be governed by and interpreted in accordance with the law.

Any dispute arising from or relating to these Terms and Conditions or the use of Shank’s services will be subject to the jurisdiction of the competent courts of South Africa.
